In short

These Terms of Use (the "Terms") are a legal agreement between you and Nasim Keshavarz, trading as Sabz ("we," "us," "the Operator"), governing your use of the Sabz iPhone app and sabz.life (together, "Sabz" or "the App"). They also serve as the end-user licence agreement ("EULA") required by Apple for apps distributed through the App Store.

By downloading, installing, or using Sabz, you agree to these Terms. If you don't agree, don't use the App. Nothing in these Terms affects your statutory rights as a consumer under the laws of England and Wales — or, if you live elsewhere in the UK or in an EU or EEA country, the equivalent consumer-protection laws of the place you live. Those rights cannot be excluded or limited by agreement, and nothing here tries to.

Who you're contracting with

This agreement is between you and Nasim Keshavarz, trading as Sabz, only — it is not with Apple, and Apple is not a party to it. Apple has no obligation whatsoever to furnish any maintenance or support services for Sabz. Section 12 sets out the specific terms Apple requires us to include, all of which apply in addition to the rest of these Terms.

What Sabz is

Sabz is a plant-care app for iPhone. It lets you:

  • track houseplants and keep a record of their care;
  • set watering and feeding reminders;
  • run a "Check-up" — a best-effort assessment of why a plant might be unwell, based on the care history you've logged plus, optionally, a photo and a note you provide for AI-assisted analysis;
  • look up pet-toxicity information for a library of plant species.

Sabz requires no account or sign-in. There is no user registration of any kind. Full detail on what data the app collects, stores, and transmits — and to whom — is set out in our Privacy Policy, which forms part of these Terms.

Licence to use the App

Subject to your compliance with these Terms, we grant you a non-exclusive, non-transferable licence to use Sabz on any Apple-branded product that you own or control, and as permitted by the Usage Rules set out in Apple's App Store Terms of Service, including use by other accounts associated with you via Family Sharing or volume purchasing, where Apple's rules permit this. All rights not expressly granted to you are reserved by us.

You may not: reverse-engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by law; rent, lease, lend, sell, redistribute, or sublicense the App; or use the App in any way that violates applicable law.

Free features and the Sabz Care subscription

Free, forever, with no account required:

  • plant tracking, watering and feeding reminders;
  • the full species library and pet-toxicity information;
  • your first three AI-assisted Check-ups, per installation. These three free Check-ups do not expire.

Sabz Care is an optional auto-renewing subscription that unlocks unlimited AI-assisted Check-ups. It's available as a monthly or annual plan, priced as shown in the App Store at the time of purchase.

5.1 Payment

All payment for Sabz Care is handled entirely by Apple through your Apple ID / App Store account. We do not process, receive, or store your card details or any other payment information — Apple's payment terms and privacy practices govern that part of the transaction, not ours.

5.2 Auto-renewal — what you're agreeing to

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews unless auto-renewal is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours before the end of the current period, at the price of the plan you selected (or a then-current price, if we or Apple have given the required advance notice of a price change).
  • You can manage your subscription and turn off auto-renewal at any time by going to your Apple ID account settings, after purchase.
  • If a free trial is ever offered, any unused portion of it is forfeited when you purchase a subscription during the trial period.

5.3 Cancelling

You can cancel Sabz Care at any time via your Apple ID account settings. Cancelling stops future renewals; it does not refund the current billing period, and you'll keep access to unlimited Check-ups until the end of the period you've already paid for.

Cancelling your subscription never deletes, hides, or locks your existing plants, photos, care history, or past Check-up results. All of that stays on your device, fully accessible, whether or not you're subscribed — an active Sabz Care subscription only controls whether you can run further AI-assisted Check-ups beyond your first three free ones.

5.4 Refunds

Because Apple processes all payments, refund requests are handled by Apple, not by us — we have no ability to issue a refund directly. You can request one at reportaproblem.apple.com or through your purchase history in Settings/App Store, subject to Apple's own refund policies. This doesn't affect any statutory right you have to a refund, repair, or replacement under UK or EU consumer law (see section 8), which we'll honour to the extent it applies to us as the trader.

5.5 Your right to change your mind (cooling-off)

If you are a consumer in the UK or the EU/EEA, you normally have 14 days from taking out a subscription to cancel it and get your money back, without giving a reason. In the UK this comes from the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013; equivalent rights apply across the EU and EEA.

Sabz Care unlocks unlimited Check-ups the moment you subscribe. By subscribing you ask us to start supplying it straight away, and you accept that once we have, you lose that 14-day right to cancel. If you would rather keep the right, simply don't run a Check-up during the first 14 days.

Where the right does still apply, you can use it by asking Apple at reportaproblem.apple.com, or by telling us in any clear statement — email [email protected] or write to the address in section 17. You may use the model cancellation form below, but you don't have to.

None of this affects your right to turn off auto-renewal whenever you like (section 5.3), or your statutory rights if the App is faulty or not as described (section 8).

Important limitations on what Sabz tells you

Sabz gives you information and best-effort assessments across three areas. Please read this section carefully — it matters for how you use the App, particularly around the safety of any pets you have.

6.1 Pet-toxicity information

Sabz shows toxicity information for the plant species in its library, covering cats and dogs only. This information is sourced from the ASPCA's published toxic and non-toxic plant lists.

This is reference information, not veterinary advice, and it is not exhaustive. In particular:

  • it does not cover every plant species, cultivar, or variety that exists, and a plant that looks similar to one in our library may not be the same plant;
  • toxicity can vary by plant part, growth stage, and the amount ingested, in ways a general species-level listing cannot fully capture;
  • it does not cover animals other than cats and dogs;
  • the underlying source data can be updated or revised over time, and our library may not always reflect the very latest version;
  • a "non-toxic" or "no data" listing is not a guarantee that a plant is safe for your pet in every circumstance, and must never be treated as one.

If you know or suspect your pet has chewed, eaten, or otherwise been exposed to any plant, do not rely on Sabz. Contact your vet or an animal poison control service immediately — in the UK, the Animal Poison Line (01202 509000, calls charged) or your own vet's emergency line; in other countries, your local equivalent. Act first and check the app after, not the other way round.

To the fullest extent permitted by law, we do not accept liability for harm to any animal arising from reliance on the toxicity information in Sabz, except to the extent that liability cannot lawfully be excluded (see section 8).

6.2 Plant-health Check-up

The Check-up feature gives you a best-effort assessment of why a plant might be unwell, based on the care history you've logged and, if you choose to provide them, a photo and a written note, analysed with AI assistance. It can be wrong. It is not a guarantee of accuracy, not a substitute for expert horticultural diagnosis, and should be treated as one input among others — including your own observation of the plant — rather than a definitive answer.

6.3 General care guidance

Watering and feeding schedules, reminders, and other care guidance in Sabz reflect general defaults for the relevant species. They are not tailored advice for your specific plant, its exact growing conditions, your climate, or your home environment, and you should adjust them based on how your plant actually responds.

Your data

How Sabz handles your data — what's stored on your device, what's transmitted, to whom, and why — is fully described in our Privacy Policy. By using the App you agree to that processing on the terms described there.

Liability

Nothing in these Terms excludes or limits our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • any other liability that cannot lawfully be excluded or limited under the laws of England and Wales.

If you're a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 — including that digital content must be of satisfactory quality, fit for purpose, and as described, and that services must be provided with reasonable care and skill. These Terms are intended to sit alongside those rights, not to replace or narrow them.

Subject to the above, and to the extent permitted by law:

  • Sabz is provided "as is" and "as available." We don't promise it will be error-free, uninterrupted, or perfectly compatible with every device or iOS version.
  • We are not liable for any loss of the data stored in your local app database — including plants, photos, care history, and Check-up results — since we hold no copy of it and cannot restore it. Back up your device (see our Privacy Policy on iCloud) if that matters to you.
  • We are not liable for indirect or consequential losses that weren't reasonably foreseeable to both parties when you started using Sabz.
  • Our total liability to you arising out of or in connection with these Terms, for matters where liability can lawfully be limited, is capped at the total amount you have paid us for Sabz Care in the 12 months before the event giving rise to the claim (or, if you have paid us nothing, we do not exclude liability but our liability is limited to what is fair and reasonable in the circumstances, taking into account that the App's free features were provided at no charge).

Intellectual property

Sabz — including its software, design, text, the species library content and its compilation, and branding — is owned by us or our licensors and is protected by copyright and other intellectual property laws. Your licence under section 4 gives you the right to use the App; it does not transfer any ownership rights to you.

Suspension and termination

You can stop using Sabz at any time by deleting the app. We may suspend or terminate your access to Sabz Care (for example, if you breach these Terms), but this doesn't affect data already stored locally on your device, which remains yours and under your control regardless of anything we do on our end — because we don't hold a copy of it, we have no ability to delete it remotely even if we wanted to.

Changes to Sabz and to these Terms

We may update the App (adding, changing, or removing features) and these Terms from time to time. Where a change is material, we'll make reasonable efforts to notify you in the App before it takes effect. Continuing to use Sabz after a change to these Terms takes effect means you accept the updated Terms; if you don't agree with a change, you should stop using the App.

Apple-specific terms

Because Sabz is distributed through Apple's App Store, the following terms — required by Apple for all apps that use a custom EULA — apply between you and us, in addition to the rest of these Terms:

  1. Acknowledgement. This agreement is concluded between you and us only, not with Apple, and Apple is not responsible for the App or its content.
  2. Scope of licence. The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, and as permitted by Apple's Usage Rules.
  3. Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support services for Sabz. Apple has no obligation whatsoever to furnish any maintenance or support.
  4. Warranty. In the event of any failure of Sabz to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for Sabz Care (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Sabz, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to a warranty are our sole responsibility.
  5. Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to Sabz or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that Sabz fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation — including, in this case, any claim relating to the accuracy of pet-toxicity, plant-health, or care information provided by the App.
  6. Intellectual property. We, not Apple, are responsible for the investigation, defence, settlement, and discharge of any claim that Sabz, or your possession and use of it, infringes a third party's intellectual property rights.
  7. Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. Third-party terms. You must comply with any applicable third-party agreement when using Sabz (for example, your wireless data service agreement) that could affect your use of the App.
  9. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
  10. Contact. Questions, complaints, or claims about Sabz should be directed to us at the contact details in section 17, not to Apple.

We're required by UK and EU e-commerce and consumer protection law to publish the following information about who operates Sabz. The same trader details are submitted to Apple and published on the App Store product page, under Apple's Digital Services Act compliance process.

Governing law and jurisdiction

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer, that choice does not take away the protection given to you by the mandatory consumer-protection laws of the country you live in. If you live in Scotland, Northern Ireland, or an EU or EEA member state, you keep the benefit of those rules, and you may be able to bring proceedings in your own local courts. Nothing in these Terms removes that right.

Complaints

If something's gone wrong, contact us first at [email protected] — we'll try to sort it out directly. We don't currently subscribe to an alternative dispute resolution scheme; if that changes we'll name it here.

General

  • Severability. If any part of these Terms is found unenforceable, the rest continues to apply.
  • No waiver. If we don't enforce a term, that doesn't mean we've given it up.
  • Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about Sabz, and supersede any earlier versions.
  • Assignment. We may transfer our rights and obligations under these Terms to another organisation (for example, if the business is sold), but this won't reduce the protections available to you under them. You may not transfer your rights under these Terms to anyone else.
